That’s a little oversimplified. To get any type of settlement you have to prove damages. I could say one of these guys is out in the yard f’ing a sheep. They may not like it but unless they can show some sort of damages they can’t collect anything.

Also, all this talk is a bit silly. However one day the chickens will come home to roost on this board or another. You’ll get a hothead like this lkfmdc who will decide to have a face to face with somebody on this board and somebody will wind up dead…then you can talk about damages.

No, you don’t have to prove actual damages for a defamation claim. It is called special damages, and proving the defamation itself creates liability in terms of damages as a matter of law. It is tricky - you would have needed to go to law school, studied a lot, and done well in your classes to know the intricacies of this type of law.

And I don’t agree that this talk is silly. If you’ve ever been wronged to the extent that you really felt it, than you know that it’s not a good feeling. Civilized people have the right to live in peace. If you want to give up that right and let people screw with you, that’s your perogative.

If there was a legit claim for a defamation ruling based on every lie told about someone, there would be roughly six people left on the internet while the rest basically lived in court. He|l, even with all the mud and vitriol being slung every which way, this place remains waaay tamer than many forums.

Having lies told about you on the internet may suck, but the only motivating factor for taking it to court without actual damages occurring is pure greed.

I understand your intuitioin on this, and yours is actually a pretty reasonable argument, but it’s wrong.

First, defamation is not created by statute, it comes from common law.

Second, just by showing, among a few other things, that there was a knowing lie based on some proposed fact that was false will create liability for damages as a matter of law. You don’t have to quantify damages or make any other showing. That falls under the special damages doctrine and is covered in an earlier post. The jury will determine what the money damages should be based on their knowledge and values.

Third, the fact that he uses a different name on the forum is not going to effect it. Defamation is tort law, and the point of tort law in to place blame against someone that wrongs another. Hardwork has some type of reputation on the forum, and that’s enough.

If you were right with your argument, then you’d be saying that the member would not be wronged no matter how many knowing lies are said, even if there’s one done every day, by many people, maliciously. The question is, would a reasonable person feel wronged if subjected to that. If I, for example, put up a post every day claiming your wife or whoever said things to me about you in secret that were very derogatory, wouldn’t you be hurt by that? And if I was knowingly lying, didn’t even know your wife, but made it seem to the community that I did, wouldn’t you feel helpless. You have a right not to suffer that in the American law.
